The Narendra Modi government has decided to revoke the Article 370 , which grants a special autonomous status in jammu and kashmir .

WHAT IS ARTICLE 370 ?

The Article specifies that Except for Defence ,Foreign affairs ,communication and ancillary matters , the parliament needs the government concurrence for applying all other laws. Thus the state residents lived under a separate set of laws , including those related to citizenship , ownership of  property , and  fundamental rights as compared to other Indian.

Amit shah also presented resolution for reorganization of jammu and kashmir .

Ladakh  will be a separate union territory without a legislature while jammu and kashmir will be a union territory with legislature.

This move of Narandra Modi came as surprise . Instead of scrapping Article 370 , They used the power given by same Article to the President to make the provision ineffective.

otherwise , Scrapping of Article 370 would require a constitutional amendment under Article 368.

But by invoking Article 370(3), The government has cleverly bypassed the amendment route .

This move by Narendra Modi  government would mean , if and when gets approval of both the houses of parliament , that India's constitution gets fully applicable in jammu and kashmir.  

The Separate Constitution of jammu and kashmir will be seized to be in operation .
